:: 10/02/2010 - QLD: new sustainability declaration form

This email is to notify real estate agents about the introduction of a simplified version of the mandatory sustainability declaration and accompanying reference guide from 4 February 2010.
 
Since 1 January 2010, sellers have been required to complete a sustainability declaration prior to marketing or offering a house, townhouse or unit for sale. The declaration identifies a home’s sustainability features. It is designed to inform both sellers and buyers about the benefits of these features and encourage improved performance of existing homes over time through market forces. 
During December and January, the Government sought feedback on the declaration from industry and members of the public. The response was that the declaration should be simplified. As a result, a second version of the declaration has been developed incorporating suggestions from key industry stakeholders as well as the general public.
 
From 4 February 2010, the new simpler version of the declaration and the reference guide will be available on the Department of Infrastructure and Planning’s website. From this date either version of the declaration can be used, however, the old version of the declaration will be phased out over time. This approach will give industry time to adjust to the new format of the declaration, as well as allowing printed supplies of the old version to be used. 
 
Any forms that have been completed prior to 4 February 2010 will still be valid for properties that are currently on the market. A new form will not need to be completed for each property. 
 
As previously announced, on-the-spot fines for failing to sign or use the sustainability declaration to market a property are proposed to commence on 1 March 2010. Meanwhile, court action can still be undertaken for those who commit serious offences.

You are encouraged to distribute this information to agents within your offices and to your industry colleagues.
